THE GENERAL FEATURES OF OMBUDSMAN IN THE WORLD AND AFTER 2010 CONSTITUTINAL AMENDMENDT IN TURKEY

Abstract
20th century is the period in which great development has been experienced about protection of human rights in the national and international arenas. While the constitutions that defend the individual rights and freedom widespread on the national base, many agreements have been signed in the international stage on the other side. In addition the thought of necessity for all actions and procedures of administration in the control of judicial justice entailed the new control mechanism named “ombudsman” which focus on justice in the state-citizen relationship. The ombudsman, which is originally based on 18th century considered to occur firstly in Sweden, spreads the democratic regions later. The ombudsman that is outside of judicial review and required by the rule of law is not a structure which is not very recognition for Turkey at the present. In this article, the ombudsman that has became prevalent on the 20th century and constitutionalized in Turkey in the recent history is explained by the theory and practical aspects.
