THE HISTORICAL EVOLUTION OF THE SUPERFICIES ON THE ROMANIAN AREA AND ITS REGULATION IN THE CIVIL CODE OF THE REPUBLIC OF MOLDOVA

Abstract
Any institution of law, in order to be perceived as such, and to understand its role in the development of social and legal relationships, needs to be viewed and studied in terms of its origin and historical evolution.Thus, in order to form a scientifically documented attitude towards a legal institution, it is imperative to study the history of this institution and its evolution over time, taking into account the specificity of each period of development of human society. This goal of this paperwork is highlighting the origin and the evolution over time of the superficies, which, in fact, has suffered minor changes towards the legal "construction" of the right, which would allow the extension of its practical applicability.At the same time, the rules contained in the Civil Code of the Republic of Moldova concerning superficies are full of contradictions, which makes it impossible to interpret them univocally.
