THE INSTITUTIONS OF HIGHER EDUCATION AS THE COMPLETE ECONOMIC ENTITIES

Abstract
In the article, on the basis of application the methods of analysis and comparison, the characteristics of the entity are compared with the characteristics of the institution of higher education. It is shown that the institution of higher education acts in economic relations under its own name, it is represented by a sole leader, the establishment has a legal address, a stamp (if it has not officially refused to use a stamp), the status of a legal entity; the institution of higher education can choose not only the organizational and legal form of the business entity, but also the commercial or non-commercial status. The institution of higher education possesses, uses and disposes of property belonging to it on the basis of property rights, the right of economic management (commercial institution of higher education), the right of operational management (non-commercial institution of higher education), may use the property on the basis of lease, leasing or concession agreements. The institution of higher education is legitimized through the passage of state registration and licensing procedures, the outcome of which is the fact of the formation and reception of the entity’s status legal. Also, the institution of higher education passes other procedures of legitimation. It has a significant amount of economic competence, in particular, it may provide, on the basis of contracts, a joint activity with educational institutions, academic institutions and other entities to provide financial, economic and other activities in accordance with the law and statute, manage their own proceeds and so on. The institution of higher education is responsible for the results of its activities and in case of committing offenses in the field of management may incur penalties, administrative and economic, operational and economic sanctions, sanctions for violation of antimonopoly-competitive legislation, etc. It was concluded that the current Ukrainian institution of higher education has all the characteristics inherent in the entity, which it is.
