Comparative advertisement as one of forms of unfair competition

Abstract

In the article the analysis of one is conducted of forms of unfair competition - illegal comparative advertisement. A comparative advertisement is classified on the personal comparative advertisement, negative comparative advertisement, positive comparative advertisement and mixed comparative advertisement. Supported the position of scientists who qualify positive comparative advertising as illegal use of another's reputation, and negative - as discrediting the entity. In the first case, the availability of competitive relations is a mandatory feature of this type of offense, the second - the existence of a competitive relationship is not mandatory.) It is suggested to make alteration in Law of Ukraine «On advertising» and Law of Ukraine «On protecting from an unfair competition» in relation to a location and opening of maintenance of the articles about a comparative advertisement and decision in the only normative act (Law of Ukraine «On advertising») of all displays of illegal advertisement, among other and comparative.
