The Legal Basis of Selling Drugs Containing Codeine (Правові основи обігу лікарських засобів, які містять кодеїн)

Abstract
circulation in Ukraine and other countries of the world, are researched. Along with elucidating the peculiarities of drugs, which contain codeine, which also include desomorphine, were characterized, as well as the features of codeine and desomorphine were clarified. Peculiarities of criminal liability for selling drugs, which contain codeine were described and examples of the relevant court practice were provided. Author’s opinion concerning drawbacks of the legal regulation in the context of liability was expressed. The procedure of selling drugs was developed, restrictions of selling such drugs without receipt were identified and the distinction between medical drugs containing narcotics and narcotic was done. Attention was paid to the circulation of recreation drugs (recreation psychoactive drugs) and the focus was made on the necessity to regulate in detail their circulation in order to combat the unlawful actions in this context. Peculiarities of circulation of drugs, which contain codeine in foreign countries, were researched. Main rules of legal regulation of this relations in accordance with international legal acts, in particular with the Single Convention on Narcotic Drugs were clarified.
