The Legal Framework of the Territorial Communitu Interests Provision in the Process of the Seaport Development

Abstract
In the article he main problems that currently hamper the competitiveness of the Ukrainian port economy are analyzed, in particular, the decrease in the volume of cargo transshipment in the seaports of Ukraine and financial and economic indicators in general, the socio-political situation in Ukraine, the imperfection of the state management system for the development of port facilities, the presence of significant competitive advantages in the ports of neighboring countries, etc. The need to strengthen cooperation between seaports and communities of the respective territories was proved, as well as the need for further legal settlement of the issue of observing the interests of territorial communities, to which the location of the seaport is assigned. The existence of a significant intersection of land use interests of the local community with the policy of development of seaports in Ukraine is substantiated. The main factors that should be taken into account when solving the issue of observing the interests of territorial communities in the process of creating legal and organizational and methodological support for the implementation of the mechanism for state management of the development of seaports of Ukraine are determined. The necessity of introducing changes and additions to the law on seaports is substantiated and appropriate recommendations are developed.
