THE LEGAL POSITION OF THE CRIMEAN REGION IN 1954: HISTORICAL AND LEGAL ANALYSIS

Abstract
The article deals with legal, political and economic preconditions of the Crimean oblast’s legal status changes in 1954. Those changes meant Crimean oblast’ territory transfer from the Russian Soviet Federative Socialist Republic to the Ukrainian Soviet Socialist Republic. Special attention has been drawn to the importance of those issues in the focus of modern political relations between Ukraine and Russian Federation. General goals of the article are definition of historical legal preconditions of the Crimean oblast’s legal status changes in 1954, analysis of that act according to the Soviet legislation and disproof of the most popular Russian myths about those issues. The article contains profound description of the historic preconditions of the Crimean oblast’ legal status changes in 1954. Russian attempts to occupy the Crimean peninsula under the earlier periods have been characterized. Special attention has been also drawn to the changes in national structure of the Crimean population as the means for artificial russification of those territories. Tight economic relations between the Crimean oblast and the Ukrainian Soviet Socialist Republic before 1954 have been examined profoundly. Due to those circumstances Russian myth about Khrushchev’s “present” to the USSR has been disproved. Profound analysis of the legitimacy of the Crimean oblast’s legal status changes in 1954 has also been made. Constitutional acts concerning those issues have been examined. All the stages of the state borders’ changing process legitimating between Soviet republics have been characterized. Russian arguments on the non-legitimacy of the following process have been criticized and totally disproved. In the conclusion it is stated that the Crimean oblast’s legal status changes in 1954 had been caused with the profound historical legal preconditions formed during previous historical periods. Those changes were made in accordance with legal acts of the Union of Soviet Socialist Republic, the Ukrainian Soviet Socialist Republic and the Russian Soviet Federative Socialist Republic. That’s why Russian state bodies have no arguments to prove their rights for the following territories.
