RESEARCH OF THEORETICAL ESSENCE OF COMPARATIVE STUDIES IN JURISPRUDENCE

Abstract
The article presents the results of a study concerning the use of methods of comparative studies in the system of jurisprudence. At the present time comparative studies are presented as a comparative law. It is shown that comparative law can be used to study both the existing legal norms and used in previous periods. The subject of the study is legal systems in their comparison. It is proved that the importance of comparative studies is expressed in the formation of methodological condition for the renewal of legal science and formation of a new national and international juridical institute that meets the conditions of modern social development. The use of methods of comparative studies allows us to develop and specify scientific ideas regarding the formation of the legal sphere. It has been proved that the received comparative results help lawyers to act both on the scale of the national system, and in the system of the international integration structure. The main problems of modern methods of comparative studies concerning general-theoretical methodical issue of development of comparative studies as a branch of legal science, legal system of modernity are shown.
