THE LUSTRATION LAW AND THE CREDIBILITY OF PUBLIC INSTITUTIONS

Abstract

The main purpose of this article is to present in a comparative perspective the reasons and the debates that surrounded the process of implementation of the lustration law, as a form of administrative justice, in East and Central Europe. Knowing that the process of dealing with the past is a key element for assuming the previous human rights violations and mistakes, the administrative justice seems to be one of the best choices in order to acknowledge the past. At the same time large criticism was brought to this method especially on the bases of human rights violations and “big shark vs. small fish” approach. In sum, this article underlines the relationship between the lustration law as a method of dealing with the past and public institutions, in order to determine if the implementation of such a law increased or decreased the credibility of public institutions.
