The practice of the US Supreme Court to extend the rights to legal entities
Journal Title: Альманах міжнародного права - Year 2016, Vol 14, Issue
Abstract
From the textual analysis of the preamble to the European Convention for the Protection of Human Rights and Fundamental Freedoms it may be concluded that coming into being of the Convention was solely due to the need of human rights protection. Even though the European Court of Human Rights extended the force of the particular norms of the Convention, which were primarily used for the protection of physical person, on the legal persons. The article of I. A. Peregontsev titled “The caselaw of the Supreme Court of USA in the area of granting of human rights to legal persons” analyses the caselaw of the Supreme Court of USA as the probable premise for the development of the European Court of Human Rights caselaw due to which legal persons may protect their rights by lodging the application to the European Court of Human Rights notwithstanding the fact that the provisions of the European Convention for the Protection of Human Rights and Fundamental Freedoms do not explicitly provide for the opportunity for legal persons to protect their rights equally as physical persons.
