THE PROBLEM OF CORRESPONDENCE HEARING OF CASE IN UKRAINIAN LEGISLATION OF CRIMINAL PROCEDURE

Abstract
The article discusses the theoretical basis for the use of the Institute of correspondence hearing of case in Ukrainian legislation. The conformity of positions of the national legislation regarding of court hearing of case with the European requirements concerning fair litigation. Analyzed approaches to the understanding of criminal procedure of the test institute. Analyzed the Institute of correspondence hearing of case at all. Discussing the experience of foreign countries and the possibility of approximation of Ukrainian legislation to the norms of the European Convention on Human Rights.
