The procedure and grounds for limiting the constitutional right of a person to health care in the legislation of Ukraine and foreign countries

Abstract
The article outlines the legitimate grounds and the permissible order of limiting the person’s right to health protection under the legislation of Ukraine and foreign countries. A comparative analysis of the fundamental constitutional principle of the legitimate restriction by the state of human and civil rights and freedoms in Ukraine and some foreign countries has been carried out; the idea is grounded on the need to differentiate the restrictions established in connection with the state of health and the restrictions of individual elements of the right of the person to health care; the specific grounds for limiting the right of a person to health protection have been identified and characterized; on the basis of the con- ducted scientific-legal and comparative analysis, it was substantiated that the constitutional law of Ukraine ap- plied the traditional approach to international law to re- strict constitutional rights; Specific proposals have been developed to improve the provisions of the Constitution of Ukraine in this area.
