The recognition and the effects of the decision authorising adoption in private international law

Abstract

The realization of any kind of international adoption is conditioned by the existence of a institutionalized structure of international cooperation in the field of international adoption. The adoption can be considered final since the moment of recognition of its effects on the territory of the state were the new family will further live. In case the international adoption is done between signatory countries of the Hague Convention regarding the child protection and the cooperation in the field of international adoption, the followed procedure must be the one imposed by the Convention. Granting the recognition of the decision for adoption is not sufficient for granting the international coherence of the status of the adopted child. It is also needed that the effects of the adoption procedure to be equivalent, at least in essence, in all the states which have to recognize it. In this case, there is a difficulty which derives from the fact that the Convention does not refer only to a single form of adoption. The institute of adoption has different aspects, according to the national legislation.
