THE RIGHT OF PROPERTY IN THE CONDITIONS OF EMERGENCY REGIMES: THE INTERNATIONAL LEGAL CONTEXT

Abstract
In the article, a theoretical study of the procedure and grounds for the requisition of property is carried out. The author analyzes the legal literature describing requisition, and normative acts regulating this process. Also attention is paid to the concept of emergency regimes and their regulation in Ukraine and Moldova, as grounds for requisitioning of property. In addition, the article contains an analysis of the cases of the European Court of Human Rights concerning the protection of property from requisition. Conclusions are drawn about the lack of the legal regulation of requisition procedures in the analyzed legislation in the light of the practice of the European Court of Human Rights.
