THE RIGHT TO PRIVACY – SOUTH AFRICAN AND COMPARATIVE PERSPECTIVES

Abstract
Aperson’ s right to privacy entails that such a person should have control over his or her personal information and should be able to conduct his or her own personal affairs relatively free from unwanted intrusions. Information protection is an aspect of safeguarding a person’s right to privacy. It provides for the legal protection of a person in instances where such a person’s personal particulars are being processed by another person or institution. Processing of information generally refers to the collecting, storing, using and communicating of information. The processing of information by the responsible party threatens the personality in two ways: First the compilation and distribution of personal information creates a direct threat to the individual’s privacy and Second, the acquisitions and disclosure of false or misleading information may lead to an infringement of his identity. Effective information protection will only be achieved through regulation by legislation.
