THE RIGHT TO STRIKE IN HEALTH SERVICE

Abstract
The author presents a specific situation of the right to strike by health care professionals. The Act of 23.5.1991 on the resolution of collective disputes prohibits the right to strike because of the need to protect the human life. In the absence of the above threat, this law limits the power to strike by doctors, nurses and medical personnel, although the ILO and Council of Europe standards of collective labor law guarantee medical personnel the right to defend their economic interests. In order to adapt the Polish law to international standards, the author presents the concept of virtual strike, which is not subject to legal restrictions. According to this concept, the decision to strike would not result in the striking medical staff ceasing toperform work and would not be associated with the loss of the right to remuneration for ongoing work<br/><br/>
