THE ROLE OF AN ATTORNEY IN RESOLVING DISPUTES ARISING FROM ADMINISTRATIVE RELATIONS WITHIN MEDIATION

Abstract
This article is devoted to the problem of implementation of mediation in administrative disputes in Ukraine. Special attention is concentrated on the role of attorney in this process. Mediation is a modern and progressive way of resolving conflicts. In Ukraine, despite the fact that the draft law “On Mediation” has been under consideration for a long time and even passed its first reading and was adopted as a basis, since 2016, no other action was taken to approve it. However, the community of mediators is actively developing in Ukraine, but more and more people find the benefits of this procedure. That is why this sphere needs an active research. Despite the fact that there is no legislative regulation of the mediation procedure in Ukraine, this alternative type of dispute resolution is applied. It has proven to be a quick, qualitative way of resolving conflicts while preserving relations between the parties for the future. In the modern conditions of doing business, public administration, interpersonal relationships, it is valued preservation of the potential for further cooperation. And disputes that may arise between the parties are solved with the help of a facilitator – mediator.
