THE USE OF THE POLYGRAPH (LIE DETECTOR) IN INVESTIGATIVE PRACTICE

Abstract
The article reveals issues of legislative regulation of the polygraph (lie detector) usage on the basis of investigators work, the Criminal Procedural Code of Ukraine and the Law of Ukraine «About legal examination». The correlation between the polygraph as a technical criminal mean and as a medical device was also studied. The article shows the basic question of criminal proceeding which is generally treated as the main prove of the polygraph results usage, and it was also clarified that investigators consider exactly the psychophisiologist's conclusions, but not the polygraph results based on the person's physiological state. We have also analyzed the regulations of the CPC of Ukraine and defined that evidence from the director's questioning are inadmissible. There are examples of successful and effective use of polygraph in the United States of America and on the grounds of this we offer the ways of legislation improvement in our country.
