THE YOUTH LEGAL SUBCULTURE: AN EXPLICATION OF THE CONCEPT

Abstract
The article treats of the question of the youth legal subculture as a component of the legal culture of the society in general and as an independent phenomenon in particular. The interest to the problem of the interrelations between the national culture of the society and the subcultures of its youth is caused by the fact that it is the youth which predetermines the different spheres of public life. The concept of a subculture, which had been introduced into the scientific circulation in the 1930s and was fixed in the Ukrainian scientific ground as interdisciplinary and interindustry only by the end of the same century, has been investigated. A number of general approaches to the research into this phenomenon has been defined, namely - class, gender, and racial, which were formed in the western scientific thinking in the second half of the ХХ century. The essence and peculiar features of the phenomenon of a subculture are clarified, among others, by such methods as system-dynamic, synergetic, informational, genetic, epidemiological, and cognitive. They form the basis for the typological study of subcultures, though, however, no uniform criteria and grounds for such studies has not yet been scientifically developed. Youth subcultures are considered as the most important one among the subcultures of all age groups. The basic approaches to understanding of the youth subculture are analyzed: on the one hand, the aforemen- tioned is based on traditional cultural values and make a link between generations, but, on the other hand, it is also an innovative formation in which outlook new reference points and values are formed. Separate indicators of the youth legal subculture are defined, in which formation the universal-biological factors along with the age features of the young are involved. The youth legal subculture covers all age groups of youth, by which quality it is seen as integral and different from legal cultures of other social groups. The content and form of expression of the youth legal subculture are predeter- mined by both concrete historical factors and the features of its legal socialisation, the period of which in the contempo- rary conditions has significantly increased. The article contributes to the understanding of the youth legal subculture as an internally difficult and extremely dynamic system. The innovative and the right-socializing functions of the youth legal subculture have been single out, and the concept of a youth legal subculture has been specified.
