Theoretical and practical problems of the search of the defendant in civil cases

Abstract
„Search of the defendant” represents an important procedural guarantee established by the legislator in favor of the defendant. Inconsideration of such a guarantee may have important procedural repercussions, even being a reason for quashing a court judgment, which is why understanding this mechanism is primarily both, from the theoretical and practical points of view. The present study follows the goal of throughout examination of the “Search of the defendant” procedure in order to bring out grounds and mechanism of its realization, but most importantly to highlight the consequences of infringement of such a procedural guarantee and examine possibilities of improving this legal mechanism.
