To investigate leaving actin anintentionalmurder crime

Abstract
To analysis the potential for intentional killing by leaving act, the act of leaving can be divided into three categories: 1–upon leavingact2–act leaving preceded by affirmative action(positive) 3–leaving act is preceded by a contract(obligation). There is no doubt that the first kind can not be considered a murderer. The second is the killer and if there is deliberate killing criteria, one is considered to be deliberate killer, but in third kind,there is dispute and in terms of the criminal law in Iran because of no specific context one can not be considered an intentional killer. However, in some instances of this kind (not all) because of failure to perform the commitment (or non-observance of the regulations), quitter can be considered guarantee in article 295, note three of the Islamic Penal Code.
