TRADE UNION ORGANIZATION AS A PARTY TO THE COLLECTIVE LABOR AGREEMENT

Abstract
Institution of collective bargaining in this country has a long tradition. In the history of Polish labor law has played a significant role in shaping the content of labor relations and mutual obligations of employers and trade union organizations. The importance of this institution was different depending on the period in which it occurred. On 29 September 1994 the Polish Parliament passed a bill amending the Act - the Labour Code and on amendments to certain acts which significantly changed the regulation on collective bargaining institutions. The most significant changes relate to the issues the parties collective bargaining agreement. The changes resulted in transforming the essence of collective agreements in the country. By the time the amendment is very limited , they were an expression of the free will of the parties . Because the parties were imposed by the legislature in such a way that a substantial uniformity circuit solutions. This resulted in that they became less authentic. It was especially noticeable during the period preceding the change. This paper focuses on the role of one of the parties to the collective labor agreement, the trade union organization, taking into account the changes introduced by the above law. The ability to conclude a consequence of social position, he earned the unions. The reason for this ability is not having legal personality. The study sought to identify the key elements associated with the trade union organizations, the party entitled to conclude the collective labor agreement. Among these issues were issues concerning trade union, trade union organization, the representativeness of trade union organization, the ability of systemic trade union organization to conclude collective agreements and organizational change on the side of the trade union organization.<br/><br/>
