Types of labor contracts under legislation of the EU member-states (the example of France, Belgium, Luxembourg and Italy)

Abstract

Introduction. The article is dedicated to study of the system of labor contracts in such EU member-States as France, Belgium, Luxembourg and Italy. Labor contracts the above member-States of the European Union and in Ukraine have many common features, but there are certain differences. Study of labor contracts existing under legislation of the EU member-states is interesting from the point of view of a possible modernization of labor legislation of Ukraine, borrowing the best European and world practices in this area, in view of the necessity to adopt a new Labor Code it also has practical interest taking into account the fact that currently a considerable number of Ukrainian citizens reside and work in countries of the European Union. Purpose. The purpose of this article is to study types of labor agreements under legislation of certain member-States of the EU and to compare them to types of labor contracts under legislation of Ukraine. Results. The most wide-spread type of labor contract in the specified countries is open-ended labor contract, it is considered as the generally-accepted, usual form of regulation of labor relations, legislation of the countries under analysis illustrate that States clearly show preference to this type of labor agreement, as it provides to the employee more guarantees. In its turn, the fixed-term labor contract can be concluded only if there is a specific reason for this that should be stipulated in the contact itself. An exhaustive list of justifications for conclusion a term labor contract in set by the legislation of the above countries. There exist other types of labor contract under legislation of analyzed member-States, such as temporary-work labor contract, intermittent labor contract, work-based training labor contract, apprenticeship labor contract, professionalization labor contract, a part-time labor contract. Conclusion. Analysis of the systems of labor contracts under legislation of France, Belgium, Luxembourg and Italy shows that they have many common features, although there are certain differences. The systems of labor agreements of these countries are very flexible, well-developed, they allow to take into account needs of different categories of employees. Introduction in Ukraine of types of labor contracts peculiar to legislation of the countries under analysis would contribute to professional integration of a bigger number of employees of different social and age categories, taking into account individual needs of each employee.
