Uczciwość wyborów jako zasada prawa wyborczego

Abstract
a legal determinant of democratic elections. It presents arguments for including this principle among the basic principles of election law, and thus for considering it as one of the fundamental legal “pillars” or the guarantees of democratic electoral process, and in a broader perspective, as one of the key principles of representative democracy or even the whole democratic system of a state. The paper also presents the issues and related electoral standards which provide the context for analyzing the fair elections principle. These are: 1) the state not being involved in the electoral competition process; 2) independence, impartiality and transparency of activity of so-called electoral administration and election “management” in general; 3) ensuring the appropriate technical and organizational conditions of voting as well as proper, fully reliable way of computing the election results and regarding votes as invalid; 4) financing of the elections; 5) effective procedures of making and considering complaints about irregularities in the electoral process as well as settling disputes; 6) criminal law protection of elections; 7) verification of elections; 8) ensuring the conditions for the elections being observed by independent international and domestic observers. Another important thing from the point of view of implementing the fair elections principle is keeping the voters informed at the proper level about the electoral process, the structure and mechanisms of exercising power, and about the candidates or parties that stand for election.
