Uprawnienia organu jednostki samorządu terytorialnego w zakresie przyznawania dotacji w świetle nowej ustawy o finansowaniu zadań oświatowych

Abstract
Z dniem 1 stycznia 2018 r. weszły w życie przepisy nowej ustawy o finansowaniu zadań oświatowych, na podstawie których ustawodawca upoważnił organ jednostki samorządu terytorialnego do m.in. ustalania trybu udzielania i rozliczania dotacji – co wynika z art. 38 ust. 1 u.f.z.o. Uprawnienia te (zbieżne z uprawnieniami przepisów ustępującej w tym zakresie ustawy o systemie oświaty) dają możliwość organowi, aby w sposób techniczny uregulował zakres danych, które wniosek musi zawierać, a nie do określania zasad oraz przesłanek, jako warunki konieczne. W artykule zostały przedstawione wybrane wyroki sądów administracyjnych (bazujących na uprzednich regulacjach), w których podkreśla się przekroczenie uprawnień przez organy stanowiące jednostek samorządu terytorialnego.
