ВПРОВАДЖЕННЯ ДЕЦЕНТРАЛІЗАЦІЇ В УКРАЇНІ: СВІТОВИЙ ТА ЄВРОПЕЙСЬКИЙ ДОСВІД

Abstract
The current issues of the modern globalization of community and Ukraine according to the deconcentration and decentralization of public authority have been analyzed in the article. The theoretical and legal aspect of decentralization as a state institution and mechanism, which is the democratic foundation and the basis of the construction of modern countries are studied. The dominant features, methods, forms and concepts of reforms of local government at the global level have been characterized. The positive and negative features of decentralization in the countries of Western and Eastern Europe have been described. It has been highlighted that the experience and practice of foreign countries is a valuable reason for the construction and implementation of effective decentralization, which is able to provide the most important established and time-tested rules, a certain foundation, functional and content basis in Ukraine. It has been determined that decentralization is one of the key and fundamental instruments of existence of the state based on democracy in the international community. It has been investigated that transition period is the current state of development of the country. This period has significant and critical disadvantages, which, unfortunately, can lead to regressive and sometimes, fatal consequences, therefore there is an urgent requirement for immediate and systematic reforms. It has been stated that local government has particular importance and influence under the conditions of political and economic crisis and becomes a fundamental state institution in each country. It has been stipulated that the local self-government institution plays a significant role in combination of the interests of the state, society and the individual, and promotes the harmonization of human and civil rights and freedoms with the interests of the state and society. It has been argued that the main task of local governments is to create conditions under which citizens reling on their own work, initiative and enterprising, in accordance with talents and perseverance, would be able to provide all their vital needs. It has been emphasized that it is important to take into account the mentality of the Ukrainian people, the traditions of state formation, the most cherished ideals and normative and valuable foundations, the specifics of the historical development and modern achievements of Ukraine during the implementation of effective decentralization. It has been stated that in the modern period of the implementation of decentralization of public authority in Ukraine there are some issues which should be studied and solved and real political will is needed for the completion of the process of reforms, the transition from centralization to decentralization. The main attention has been paid to the peculiarities of the development of the process of decentralization in Sweden, Poland, Germany, Latvia and France. It has been researched that the experience of European countries makes it possible to distinguish the main models of local self-government that have developed during municipal reforms. It has been investigated the current state situation of the reform of the mechanism of decentralization in Ukraine and has been given recommendations for further development.
