Vulneración del derecho a la defensa por falta de notificación en procedimiento administrativo sancionador

Abstract
The right to defense is a fundamental pillar in any administrative sanctioning procedure; the lack of notification of the instruction ruling contradicts this right, affecting the fairness and transparency of the process. This study is descriptive and non-experimental, analyzing the regulations and practices in Ecuador and comparing them with those in Colombia and Peru to evaluate how the lack of notification influences the defense of citizens. Dogmatic-comparative, analytical-synthetic, and inductive-deductive methods were applied, using documentary observation and a thorough bibliographic review. The results reveal significant deficiencies in the notification of the instruction ruling in Ecuador, limiting the exercise of the right to defense and suggesting the need to improve notification mechanisms. The conclusions highlight the urgency of implementing more effective administrative practices to ensure fairness and justice in sanctioning procedures
