Ways of protecting the subject of investment activity rights

Abstract

The article is devoted to the definition of the peculiarities of protection of the rights of subjects of investment activity in the international private law. The author finds out the concepts and basic principles of regulation of investment activity, determines ways of protecting investor's rights in private international law, as well as state-legal guarantees in the field of regulation of investment activity. The main international legal acts in the field of international investment law are grouped according to: the level of international legal regulation (global and regional), as well as the range of legal relations that are regulated. The purpose of the article is to analyze the peculiarities of regulation of investment activity on the example of Ukraine and the countries of the world, the correlation of common and distinct features between them in order to identify and identify the prerequisites for improving the organization of the investment market of Ukraine. Today, foreign investors have equal rights in carrying out these activities and independently determine the goals, directions, types and amounts of investments. In addition, they can own, use and manage investment assets, including reinvestment in Ukraine (reinvestments – moving capital from one asset to another, more efficient). As a result methods of implementation of investment policies of developed countries are aimed at clear restrictive / or vice versa stimulating measures. At the same time, in the context of transition to an innovative type of economic development of Ukraine, and in particular formation, taking into account the ongoing armed conflict, a policy of stimulating investor activity, providing guarantees to investors and other measures to support investment activities, as well as having the necessary infrastructure is required. This is important for the integration of our country into the world economy as an influential, rather than dependent, participant of export-import turnover, expanding the possibilities for implementation of innovative projects, partnership activities and foreign trade operations.
