Weryfikacja rozporządzeń wojewody w trybie nadzoru i samokontroli

Abstract
Voivodes’ ordinances are manifestations of local law-making in the domain of public duties pertinent to government administration. There is an established praxis that voivodes legislate local law in shape of ordinances which are in force in the given voivodship or part thereof. Ordinances have their place in the constitutional system of sources of law albeit they cannot be equated to regulations issued by the national administrative organs. Since the issuance of ordinances by voivodes is indicative of legislative activity of centralized administration, supervision of this activity is based not only on the criterion of lawfulness but also on the criterion of reliability and economy, and compliance with government policy. Supervision, however, is not exclusive form of verification of voivodes’ ordinances because these authorities may, in the framework of self-control, overrule or change their acts on their own. This happens, nevertheless, under the inspiration of the supervisory authority. Verification of the voivode ordinance, one way or another, entails that an act shall cease to apply and is removed from the legal system, and is replaced with a new legal regulation. Rozporządzenia wojewodów są przejawem lokalnego prawotwórstwa, w obszarze wykonywania zadań publicznych przynależnych administracji rządowej. Utrwaloną praktyką jest, że w formie rozporządzenia wojewodowie ustanawiają prawo miejscowe, obowiązujące na terenie województwa lub jego części. Rozporządzenia wojewodów posiadają swoje miejsce w konstytucyjnym systemie źródeł prawa, aczkolwiek nie można ich utożsamiać z rozporządzeniami wydawanymi przez ogólnokrajowe organy administracyjne. Ponieważ wydawanie rozporządzeń przez wojewodów jest przejawem aktywności prawodawczej administracji scentralizowanej, nadzór nad tą aktywnością oparty jest nie tylko na kryterium legalności, ale także na kryterium rzetelności i gospodarności oraz zgodności z polityką rządu. Nadzór nie stanowi jednak wyłącznej formy weryfikacji rozporządzeń wojewodów, albowiem organy te mogą w ramach samokontroli dokonywać uchylenia lub zmiany swych aktów we własnym zakresie. Dzieje się to wszakże z inspiracji organu nadzoru. Weryfikacja rozporządzenia wojewody, w takim czy innym trybie powoduje, że ów akt przestaje obowiązywać i zostaje usunięty z obrotu prawnego. W jego miejsce można jednak ustanowić nową regulację prawną
