Характеристика злочину геноциду в рішеннях міжнародних судових органів / Characteristics of the Crime of Genocide in the Case Law of the International Courts

Abstract

This article explores the concept of the crime of genocide as it is interpreted in the decisions of the international courts, including the ICTY, ICTR and the ICC. The author analyzes the nature of the crime of genocide under international law concluding that the prohibition of genocide is a norm of conventional law, customary international law, general principle of law, jus cogens norm and an obligation erga omnes. Furthermore, the approaches to the elements of the crime of genocide are examined as they are defined in theory of international law and also in the case law. After the detailed analysis of the mens rea element of the crime of genocide, the author observes the transition from purpose-based approach used by the ad hoc Tribunals to the combined purpose-based and knowledge-based approach applied by the ICC. The development of the contextual element in the case law of ad hoc tribunals and its subsequent introduction to the Elements of Crimes of the ICC is described. The acts constituting actus reus of the crime of genocide are explored. The author concludes that all three types of genocide, namely physical, biological and cultural genocide, which were originally offered by Raphael Lemkin for the Genocide Convention, have been preserved in its final version, although cultural genocide was included only in the abridged form. Overall, the prognosis is made that while ad hoc Tribunals were preoccupied with development of the concept of the special intent as an element of the crime of genocide, the ICC will focus on the conceptual development of the contextual element of this crime.
