ЗАГАЛЬНІ ПІДХОДИ ДО КОНСТИТУЦІЙНО-ПРАВОВОГО РЕГУЛЮВАННЯ ГОЛОСУВАННЯ У КРАЇНАХ ЗАХІДНОЇ ТА ЦЕНТРАЛЬНОЇ ЄВРОПИ

Abstract

The paper studies the realization of the constitutional right to free elections during the voting. The general approaches of constitutional legal regulation of voting in the countries of Western and Central Europe are investigated. The article analyzes the international electoral standards that are used in the formation of public authorities and local governments in the countries of the European Union. The basis of election standards on a Single European Area are the standards of the OSCE and the EU. The article reveals the sources of regulation of the voting stage; status of voters and elected; election management bodies; procedural aspects of the forms and methods of voting in the countries of Western and Central Europe. The experience of forms and methods of voting in the EU countries such as voting by mail, Internet voting, early voting, voting by proxy are analyzed in the article. Participation in the voting stage is realized by citizens on the basis of common and equal suffrage. The legislation of the countries of this region prohibits the use of discriminatory signs in the application of restrictions to voting. A wide practice in Europe has become compiling a voter register. In the countries of Western and Central Europe, there is a practice of applications of specialized bodies of electoral competence and bodies to which electoral authority have a delegated character («election administration bodies») in Sweden, Great Britain, Cyprus and other. Methods of voting in the countries of this region demonstrate the preservation of classical or selectable alternative voting methods as well as the practice of automated voting methods. The rapid development in the EU countries is gaining voting over the Internet. Positive experience of experiments in the Internet voting have Norway, Ireland. Absentee voting in Germany, Denmark, Great Britain, elections to the European Parliament is an extended practice. In Western and Central Europe, early voting is limited. Early voting provided by the laws of Portugal, Finland. The article provides an analysis of legal regulation and enforcement in the organization and conduct of the voting stage in the EU according to international and regional electoral standards.
