ЗАПОВІТ ЯК ЖАНР ЗАПОВІДАЛЬНОГО ДИСКУРСУ ТА ПІДХОДИ ДО ЙОГО ДОСЛІДЖЕННЯ

Abstract
Статтю присвячено дослідженню заповіту як жанру заповідального дискурсу. Окреслено значення терміну «правовий дискурс» та визначено його місце в інституційному дискурсі. Визначено місце заповіту в жанровій палітрі заповідального дискурсу та запропоновано підходи до його дослідження. The article is devoted to the study of Last Will and Testament as a genre of inheritance discourse. The notion of the term legal discourse is outlined and its place in the institutional discourse is determined. Legal discourse plays an important role in modern linguistic research on discourse. It provides an institutional function; thus, coordinates rules in society. Various types of legal discourse have been investigated, however a genre of Last Will and Testament hasn’t been researched in linguistic studies. English lawyers define a will as a document by which a testator disposes his / her property to heirs after death and appoints an executor of the will. It is written according to the requirements of the Wills Act 1837. Last Will and Testament genre features are determined by the interest of modern anthropocentric Linguistics in aspects of discourse formation and functioning, speech genres and speech acts, which are seen as categories of such a modus as communication. There is no single approach to the definition of legal discourse as well as there are no clear criteria for its typology. A place of Last Will and Testament in the genre palette of inheritance discourse is defined and approaches to its study are proposed. An attempt to define approaches to legal discourse analysis claims that modern researchers concentrate on the analysis of legal texts and documents (thus, linguistic aspects) but not on discursive ones. In general, approaches applied to the analysis of various discourse types can be applied to the analysis of legal discourse as well as inheritance discourse as a subtype. The following approaches are productive for Last Will and Testament genre as a genre of legal discourse: 1) approach which applies critical discourse analysis; 2) functional and pragmatic approach; 3) cognitive approach; and 4) lingual and cultural approach. The first approach studies Last Will and Testament as a discursive practice which was historically established. The second approach shows that Last Will and Testament is a logical set of performative speech acts with illocutionary force which are the acts of bequeath. Cognitive approach is defined by the contexts. ‘Contextual modal’ is essential for text interpretation (death, illness, war, political and cultural aspects, family relationship etc.) Last Wills and Testaments are also helpful to study history and culture of the country. Layout, lexical features, cultural markedness display lingual and cultural features of wills. The third of 19th century wills have ‘spiritual part’ in which an author bequeaths his/her soul to God.
