ЗАСТОСУВАННЯ СПЕЦІАЛЬНИХ ЗАСОБІВ У ПРАВООХОРОННІЙ ТА ПРИВАТНІЙ ДЕТЕКТИВНІЙ ДІЯЛЬНОСТІ. НОРМАТИВНЕ ЗАБЕЗПЕЧЕННЯ У ЗАСТОСУВАННІ СПЕЦІАЛЬНИХ ЗАСОБІВ

Abstract
The issue of application of special means in law enforcement and private detective activity, as well as normative support in this issue is being explored. In addition, the concept of private detective activity and special means are also revealed, as well as the use of special means in the performance of official duties by law enforcement officers. Also, the question of the use of special means is investigated. The methodology and methods of using these tools are developed taking into account practical experience and analytically summarized in the activities of the criminologist. This article also covers the concept of what a private detective represents, which documents give permission to conduct detective activity and regulate such activity. The procedure for the use of special means, especially the vowel and secret use of special means in the conduct of private detective activities. In the process of research were used comparative-legal (comparative analysis of individual provisions of legal acts), formally-logical (classification types of special means), functional (the dynamics of special means), statistical (use of statistical data, generalization of world experience). Subjects of private detective (search) activities carry out detective activity throughout the territory of Ukraine, unless otherwise provided by an international agreement, the consent to be bound by which is provided by the Verkhovna Rada of Ukraine, or by the legislation of a foreign state. The issue of the procedure for obtaining the certificate of the right to engage in private detective activity and the requirements for candidates for private detectives are also covered. The article also addressed the issue of normative provision of private detective activity in Ukraine. An important and special consideration for our study deserves the analysis of legal norms regulating the use of weapons and special means contained in departmental regulations, in particular, the Ministry of Internal Affairs of Ukraine.
