Abstract
Although the marriage concluded abroad is not an extraordinary situation it has a definitr specifics. Among the premarital formalities to be completed in the state of marriage very often there is a requirement of formal confirmation of the possibility of marriage from the country of origin of the nupturients. The possibility of obtaining the relevant certifi cate by Polish citizens and aliens subject to Polish law, provides art. 83 of the Polish Registry Office Records Act from 2014. The article presents the historical development of the certificate about capacity to get married, as well as its shape under Polish law. Widely analyzed is the concept of “possibility of marriage”. Presented are also rules for verifying the refusal to issue the certificate, which is carried out by a common court.
