Abstract
Th e main theme of this article is entering into marriiage by a foreigner in front of a Polish head of the registry offi ce. Article indicates that to the marriage of a foreigner which is celebrated in Poland legal normes of two legal systems are applicable – lex loci celebrationis matrimonii (Polish law) is applicable to the formal requirements of marriage and lex patriae of the foreigner (foreign law) is applicable to the substantial validity of marriage. In exceptional cases, described in detail in the text, the substantial validity of a marraige may also be subject to Polish law. If it is a foreign law that is applicable to the entering into marriage by foreigner, a foreigner must present to the Polish head of the registry offi ce a document confi rming that, in accordance with the applicable law, he/she may enter into marriage. Practical problems arise when such a document is issued by the authorities whose governance Poland does not recognize. The article suggests possible solutions to the above problem.
