ЗАХОДИ ЩОДО ПРОТИДІЇ ДОМАШНЬОМУ НАСИЛЬСТВУ: ПОРІВНЯЛЬНО-ПРАВОВИЙ АНАЛІЗ ЗАКОНОДАВСТВА УКРАЇНИ ТА РЕСПУБЛІКИ МОЛДОВА

Abstract
The article is about the comparative and legal analysis of the legislative regulation of measures against domestic violence in the legislation of Ukraine and the Republic of Moldova. Accordance with the research, it is stated that the counteraction to the domestic violence in the legislation of these countries is carried out within the various branches of the law. In criminal law, such counteraction is achieved by using punitive and / or alternative non-punitive measures of protection. It is emphasized that in the Criminal Procedure Code of the Republic of Moldova, the procedure of the defence, if a person committed a crime connected with domestic violence, actually shows their that it belongs to criminal-land-law measures, although the appropriate measures are not specified in the Criminal Code of the Republic of Moldova. It is mentioned that such practice is unlikely to be positively evaluated in the context of its possible implementation to the domestic criminal law.
