ЗНАЧЕННЯ ПСИХОЛОГІЧНИХ ОЗНАК ОСОБИ ЗЛОЧИНЦЯ: КРИМІНОЛОГІЧНИЙ АНАЛІЗ

Abstract
The article defines the main features of the person of the offender. The significance of the psychological features of a person of a criminal for criminal-legal qualification of crimes is analyzed. Groups of crimes are considered, where psychological features of the offender’s personality play a crucial role. These include violent crimes committed with particular cruelty, crimes committed on the basis of addiction (alcohol, drugs, toxic, gambling), crimes of persons with mental disabilities or anomalies (which are the basis for recognizing them as limited in charges) or xenophobia (in the sphere of violation of freedom of religion, terrorism), the commission of crimes in a state of strong emotion and other relevant states. It is noted that the identity of the offender must be spoken in the case when it comes to a certain system of criminal acts. This is due to the fact that the person is formed in the process of activity (in particular criminal). The commission of criminal acts affects the psychological structure of the individual, the emergence of an anti-social orientation (setting). Practice proves that we can not restrict ourselves only to the statement by the court of the appointed form and the size of the punishment and the mere performance of the latter. We must try to influence this person in such a way as to qualitatively change its worldview and legal thinking, attitude, consciousness, hierarchy of value series, and generally raise personal development to a new level. It is worth noting that at present, serious murders are a serious social danger. The psychology of the ordered murder is characterized by a complex chain of interactions: the customer – the performer, or the customer – the intermediary – the performer, or the customer – several intermediaries – the performer.
