About the Possibility of Introducing of Substitution Therapy in Prison

Abstract
In the article through the prism of the rights of prisoners and detained persons to receive medical care the state of implementation in the Ukrainian so-called prison the practice of substitution treatment is disclosed. It is noteworthy that a characteristic feature of the legislative regulation of issues related to legal circulation of narcotic substances in Ukraine, is that a number of legislative provisions allegedly dispersed by normative legal acts of various branches of law. On the basis of the current legislation taking into account proven, including the world, the effectiveness of this therapy the author concludes that any obstacle in its implementation should not exist, particularly in places of deprivation of liberty. However, analysis of the various factors shows that today this factors actually impede further spread of the practice of substitution treatment in all places of detention, in which the convicts and detained persons are convicted. Among these factors it should highlight the organizational, legal, material, ethical factors, etc. The absence of substitution therapy in prison is currently determined by uncertainty of the procedure of implementation of these programs at the level of departmental regulations. The article focuses on the history of implementation of this therapy. Numerous studies demonstrate that the implementation of substitution therapy in the places of deprivation of liberty brings significant benefits, reducing the craving for drugs, negative behavior and the number of violations of the regime, but unfortunately in Ukraine it is not yet available. The provisions of the Procedure of Interaction of Health Care Institutions and Units and Organs of the National Police of Ukraine, the National Guard of Ukraine, Detention Centres, Establishments of Execution prescribed and the Criminal-executive Inspections on Conducting the Substitution Maintenance Therapy of Patients with Opioid Dependence have been analysed. It is emphasized that it is necessary to accelerate the procedure of adoption of the developed and submitted for public discussion of this document.
