ACTIVITIES OF THE PROSECUTOR FOR ENSURING HIS PARTICIPATION IN COURT SESSION IN THE FIRST INSTANCE

Abstract
The article is devoted to the scientific analysis of procedural activities of the prosecutor for ensuring his participation in court session in the first instance. It is specified that questions of a formulation of charge of pre-judicial production, problems of preparation and participation of the prosecutor in judicial in court session in the first instance are of particular importance in the conditions of competitive criminal trial. This activity of the prosecutor is actually carried out on border of two stages of criminal proceedings: she finishes a stage of pre-judicial investigation and provides the beginning of a stage of preparatory production. Lack of her appropriate legislative settlement, ambiguous interpretation in the theory of a criminal procedural law and practice of its application is stated.
