ACTUAL PROBLEMS OF PREVENTION OF MOBING IN LABOR RELATIONS IN UKRAINE

Abstract

The article investigates the socially harmful phenomenon in society as a distress in the workplace “mobing”. The analysis and experience of normative legal regulation of counteraction to these phenomena in some European countries have been analyzed. Legislation in Ukraine does not provide for responsibility for pressure and harassment in the workplace. The research is devoted to the concept of oppression (mobing) and the reasons for the onset of distress in the workplace. The main types of mobing are analyzed: vertical and horizontal, open and latent. According to statistics in Ukraine, every second Ukrainian has been mobbing in one form or another. The reasons of reduction of work efficiency at the employee are cited. There are cases of occurrence of mobing in the collective of the enterprises of the organization of the organization of the organization to the employee, subordinate and leader, ways of prevention and removal of the person from mobing, as well as the duties of the manager to identify the mobing among subordinates, the analysis of the draft law submitted by people’s deputies was made. N.V. Veselova and S.P. Melnichuk № 10118 “On Amendments to Certain Legislative Acts of Ukraine on Mobing”. The positive characteristics given in the case of the adoption of the law on prevention of mobing in the labor force are presented – as a result, the microclimate in labor collectives will improve and productivity of labor, enterprises, institutions and organizations will increase. The recommendations and proposals on preventing and overcoming moral persecution by the employer and other employees are given. The necessity of reforming the labor legislation of Ukraine in order to protect the rights and interests of workers exposed to continuing psychological violence or pressure in labor relations is presented. The European Labor Law and Labor Law in Ukraine are analyzed. It is concluded that the labor legislation of Ukraine is out of date and needs to be amended. In Ukraine there is a lot of privilege for the leader to control and dismiss an employee.
