CRIMINAL-LEGAL PROTECTION OF PROPERTY UNDER THE LAW OF SEVERAL COUNTRIES WITH A MIXED (CONVERGENT) TYPE OF LEGAL SYSTEMS

Abstract
The article deals with the issues of criminal legal protection of property under the legislation of some countries with a mixed (convergent) type of legal systems. The relevance of the study of criminal legal protection of property under the laws of some countries with a mixed (convergent) type of legal system is beyond doubt. The relevance of the article is primarily due to the globalization processes in the world and the active cooperation of the countries of the world in various fields. In legal science, the so-called “mixed (convergent) type of legal systems” is singled out. There is no consensus on the content of the concepts of “mixed legal system”, “mixed type of legal systems”. Researchers define such a concept as a set of national legal systems that have the most common patterns of development and similar features that have developed both on the basis of local sources of law and by borrowing certain elements of RomanoGermanic and Anglo-American law. The analysis showed that a separate group of countries with a mixed type of legal system is a set of national legal systems that have the most common patterns of development and similar features that have developed both on the basis of local sources of law and through the borrowing of separate elements of the rights of different legal families. There is a general relationship not between the countries of this group, but between the countries of this group and the countries of the legal families that became the basis for borrowing. In the legal system of Israel, there are elements of the Anglo-Saxon legal family, in particular, when qualifying theft. According to foreign scholars, given the history and sources of the Maltese legal system, it can be argued that it has features of the continental family, but also absorbed many features of the common law tradition (Anglo-Saxon).
