АДМІНІСТРАТИВО-ОРГАНІЗАЦІЙНІ ПИТАННЯ ЩОДО ВИЗНАЧЕННЯ ОКРЕМИХ ПОВНОВАЖЕНЬ ТА ФУНКЦІЙ КАПІТАНА У СФЕРІ ДІЯЛЬНОСТІ МОРСЬКОГО ТОРГОВЕЛЬНОГО ТРАНСПОРТУ

Abstract
The article deals with the issues of powers and functions of a sea vessel captain and a port master. The problematic aspects that arise in the process of law enforcement in the field of marine shipping have been highlighted. A comparative analysis of legal regulation of the captain’s functions concerning the administrative and criminal detention of a person has been carried out. The legal grounds for hearing cases of administrative offenses and imposition of administrative penalties by a port master in the process of state control over compliance with legislation and rules of navigation have been described. The theoretical and practical ways for improvement of the legislation stipulating management organization on the merchant shipping have been offered. The conclusion has been made about the weak legal mechanism for the implementation of captain’s organizational functions on merchant vessels. The author's definition of the concept of "administrative and organizational functions of a ship captain or a port master" has been offered: it is a set of organizational and administrative powers implemented by techniques and methods in the field of management of a ship (including navigation) or a port which constitute the mechanism of the captain's influence, as the subject of management, on the object of management; they objectively manifest themselves in the formation of organizational relations between participants in social relations in the field of marine transportation, based on the manegement decisions and legislation (laws, decrees, regulations, orders, instructions, guidelines); they help to regulate the functioning and proper organization in accordance with the tasks.
