ADVANTAGES AND DISADVANTAGES OF STANDARDIZED TERMS OF CONTRACT

Abstract
Abstract In principle, the contract is established by mutual and compatible explicit or implicit declarations of will within the framework of the principle of freedom of contract, negotiated by the parties who do not have any dominant position over each other in terms of social, economic, etc. However, as a result of the economic developments and changes of our age, it is seen that one party of the contract has concluded similar contracts with more than one person, with the provisions previously prepared by its unilateral will. Examples of application areas of such contracts for the masses are: loan contracts of banks, sales contracts of construction companies, contracts in the marketing of durable consumer goods and automobiles, or contracts in the field of travel, transportation and tourism6. In such contracts, the other party will either conclude the contract with the conditions offered to it or will have to give up receiving the performance or service contained in the contract in question. In this case, it will disrupt the equality of the contract and the balance between the parties in favor of the business.
