AN EXAMINATION OF THE IMPACT OF IMITATION ON THE COMPETITIVE LANDSCAPE WITHIN THE FRAMEWORK OF INTELLECTUAL PROPERTY RIGHTS

Abstract
Abstract The application of provisions, purposes, and issues results in different intellectual property rights and unfair competition. The provisions pertaining to the prohibition of unfair competition are based on the principle of safeguarding labour integrity and are aimed at protecting free competition. The principle of cumulative effect weighted opinion is the basis for the interaction between the regulations of protection in terms of intellectual property rights and the prevention of unfair competition. According to this approach, rules regarding the prohibition of unfair competition and intellectual property rights can be immediately implemented. Product copying alone will not be considered unfair competition when it comes to unregistered industrial products. If a product's original characteristic is protected, it is exempt from copying. However, if there is a possibility of confusion, it may be considered unfair competition.To prevent the mixing of different indicators and ensure safety, it is crucial to take adequate safeguards. These issues pertain to the application, protection, and blocking of trademarks. When settling difficulties, it is crucial to adhere to the principle of honesty and to set clear boundaries for the right to act, leaving no space for doubt or uncertainty.
