Abstract
The article is devoted to the study of immoral misconduct, which is incompatible with the continuation of work related to the performance of educational functions, as a basis for terminating an employment contract with a scientific and pedagogical worker. It is proved that the incompatibility of immoral offense with subsequent work is not only an attempt by the legislator to formulate a certain criterion for concretization, but the most just and possible in this situation definition of the boundaries of the appraisal of «violation of morality» as a legal basis for terminating an employment contract with a scientific and pedagogical worker, as a subject of the educational process. In the course of the research, the author forms and proposes to fix in the future Labor Code of Ukraine the definition of immoral misconduct incompatible with the continuation of this work by an employee performing educational functions.
