Asigurarea independenţei judecătorilor prin prisma garanțiilor constituționale

Abstract
Every magistrate proceeds daily with the measure of his own performance, as well as between the means offered by the parties for his decision and those which are necessary. In this sense, he is constantly concerned with measuring the performance of his practice. Objective measures serve justice without undermining independence if their design, dissemination and use is in a participatory context. They make it possible to increase the responsibility of the judicial system vis-à-vis the litigants and thus its independence vis-à-vis the other powers of the State. The proposed research concerns the examination of the legitimacy of judges’ performance measurement systems in relation to all the fundamental principles of justice. To claim that judges need to function effectively, respecting principles such as those contained in Article 6 of the ECHR, it is a complex statement.
