Unele particularități ale restabilirii documentelor judiciare dispărute în procesul penal din Republica Moldova

Abstract
During the criminal trial or after finalization, the judicial bodies may find out directly or may be notified of the disappearance of judicial documents of a criminal case or even of the whole file. As the disappearance of documents or file may paralyze the conduct of procedural activities in the case in question, the criminal procedure law contains special provisions to remedy this situation, provisions derogating from the ordinary procedure. This special regulation is imposed by the need of existence in the case file of the whole evidence in order to solve and to prove the entire activity of the judicial bodies. Therefore, through this procedure, the reunification of the documentary procedural content of the case file is achieved, which is necessary for the normal conduct of the criminal proceedings or the fair resolution of some cases concerning a final criminal case.
