ASSESSMENT OF THE STATE AND PROBLEMS OF THE LABOUR MARKET REGULATION IN UKRAINE

Abstract

This article addresses the state and systematizes issues of labor market regulation in Ukraine. It is proved that labor market responses to crisis and behavior are multiple due to: various types of institutional structures of the labor market and the economy as a whole; specific features of their impact on basic labor market indicators; national models of labor market regulation; the behavior of the government, households, organizations, businesses and others during crisis. The article specified and systematized components of the government regulation of the labor market that require a combination of components of the labor market and employment policy which are as follows: legal, regulatory, financial, and organizational. The condition and problems of each component were specified. Among them are: excessive over-regulation of the labor market; the lack of an effective monitoring system; financial constraints for all insurance components resulted from relief on the Single Social Contribution rate; a shift of the State Employment Service organizational structure from a bureaucratic organization to a modern service organization of a new type should lead to its functioning as an intermediary between jobseekers and employers; the emergence of a large informal sector that is free from formal regulators brings complexity to the state system of employment; the coverage of career guidance services differs much between IDPs and ATO participants; the number of participants in voucher programs is steadily declining due to changes in the conditions of the program. Having studied the mechanism for contractual regulation of the labor market, it was proved that conclusion of the general, sectoral and territorial agreements is not synchronized; the level of responsibility for failure to comply with contracts and collective agreements is very low; components of the labor market regulation at the government, industry, territorial and collective levels are not quite consistent; there is a lack of transparent mechanism for separating the authority to regulate the labor market between the government, sectoral, and local authorities and local self-governments; there is a lack of the settled mechanism for collective bargaining at all levels of social dialogue; all the documents have poor provision for implementing state guarantees of a regulatory role of the labor market for IDPs, ATO participants and their families, persons with limited capacities, persons with disabilities and others. The author has proposed an original approach to understanding the harmonization of interaction between the government regulation and self-regulation of the labor market.
