On the Mortality of Leviathan. Private Law Enforcement in the Modern Libertarian Doctrine
Journal Title: Krytyka Prawa. Niezależne studia nad prawem - Year 2012, Vol 4, Issue 1
Abstract
The author presents a libertarian alternative for state police and law enforcement. The theoretical construction based on non-aggression axiom and the primacy of individual freedom offers the vision of spontaneous order instead of legal positivism and state monopoly over security. According to the concept of spontaneous order, security and conflict resolution services would be provided by agencies operating on the free market. Their being subjected to market mechanism would, according to libertarians, ensure higher efficiency, minimize costs and eliminate the wide sphere of criminality created by the state itself.
