The Restitution of Private Property. The Reprivatisation of Central and Eastern Europe
Journal Title: Krytyka Prawa. Niezależne studia nad prawem - Year 2009, Vol 1, Issue 1
Abstract
This article concerns a problem that generally not much attention is given to, namely the restitution of property confiscated by communistic regimes in Central and Eastern Europe. After the fall of communism, new democratic governments and parliaments faced the problem of paying compensation to former property owners. This problem contains an aspect relating to investor trust as well as aspects of moral, symbolic and emotional character. Very often this problem becomes a pawn in political games. The laws adopted and presented in the main countries of the region are analysed and compared. The political, economic as well as institutional reprivatisation context is analysed. From the point of view of the main presumptions of property restitution different kinds of reprivatisation formulas that are adopted in this region are evaluated.
